ACCOMMODATION TERMS AND CONDITIONS
Marrakech Riad is a trading name of HipMarrakech.com Ltd, whose registered office is Unit F Whiteacres, Whetstone, Leicester LE8 6ZG (“we/us/our”). Please read these booking terms and conditions carefully as they apply to all bookings made on this site.
We reserve the right to vary these terms and conditions to meet clients’ particular requirements, for example if a group needs time to collect deposits to secure a whole riad booking, or if there is a specific need to vary cancellation policy. Any variation must be agreed in writing before a deposit is paid, confirmation issued and a binding contract comes into existence.
Your contract
In order to make a booking, please check availability by completing the contact form online, making clear the number of people in your party and your preferred travel dates. We will get back to you as soon as possible to confirm availability. If the riad is able to accommodate your booking, you will be asked to provide details of your meal and other requirements (including any allergy or dietary requirements) including full flight information if you wish to use the airport transfer service. A booking is made on the terms of these booking conditions. When you make a booking, you guarantee that you have the authority to accept and do accept on behalf of your party the terms of these booking conditions.
If you make your booking within six weeks before you travel, you must pay the full amount due. If you are booking more than six weeks in advance you may pay a deposit of 50% of the total cost, your booking will then be confirmed by email and it is at this time that a binding contract comes into existence. The balance must be paid to us at least 4 weeks before you travel.
The contract is subject to these booking terms and conditions and to the law of England and Wales and the exclusive jurisdiction of the English courts.
Once the contract is made, it is our responsibility to provide you with what you have booked and it is your responsibility to pay for the accommodation. If you do not pay any amount when it is due, your booking will be cancelled and you will be liable to pay cancellation charges. All relevant documentation will be sent to you via email. It is important to check carefully all the details of your booking once you receive it and to contact us immediately if you have any queries. We will not be responsible for any information you do not receive, as a result of your failure to provide a valid e-mail address. If you want to cancel or amend your booking at a later date, you may have to pay cancellation or amendment fees; these could be a much as the whole cost of accommodation.
Insurance
It is strongly recommended that you and all members of your party have adequate travel insurance to cover the cost of cancellation, medical and repatriation expenses and loss of or damage to property.
Our price guarantee
Prices on our website do change from time to time; prices can go up as well as down and you will be able to determine your up to date price for your chosen accommodation prior to confirming your booking. Please note once you have agreed a price and made your booking this is the price you pay. If the price decreases, you are not entitled to the accommodation at the changed rate.
Payment and charges
We accept payment by bank transfer or we have a facility to take cards either over the phone or through our secure payment gateway. Paypal transactions are subject to a 2% handling fee.
Minors
We will not accept bookings from minors. You must be 18 years of age or over and have legal capacity.
Special requests
If you have any special requests that do not form part of the standard accommodation services as described in this website (for example disabled access, dietary needs, cots, bed type) please let us know before booking. Regrettably, the old city of Marrakech, with its very narrow streets and ancient buildings, does not lend itself to disabled access and if you or any member of your party has reduced mobility or other special requirements, you may be advised to book one of the modern hotels elsewhere in Marrakech. Where, however, you have other requests, we will pass these to the riad, but unfortunately these can not be guaranteed.
Smoking policy
Please note that smoking is not permitted in the riads, with the exception of certain areas on the open parts of the roof terraces.
If you want to cancel your booking
If you want to cancel a confirmed booking, you must notify us in writing at the earliest opportunity. You will be liable to pay a cancellation charge, calculated on the following scale:
Cancellation charges, days pre arrival and first check in, as a percentage of the total price payable.
28 days + from arrival 20%
8 to 27 days from arrival 50%
7 to 0 days from arrival 100%
Cancellations notified directly to the accommodation will not be effective. All cancellations or amendments must be made directly to us in writing by the person who made the original booking.
If you want to change your booking
If, after our confirmation invoice has been issued, you wish to change your travel arrangements in any way, for example your chosen dates or accommodation, we will do our utmost to make these changes but it may not always be possible. Any request for changes to be made must be in writing from the person who made the booking. You will be asked to pay reasonable administration charges, any increased cost of the accommodation and any further cost we incur in making this alteration. You should be aware that these costs could increase the closer to the departure date that changes are made and you should contact us as soon as possible.
If we change your accommodation
Every effort is made to provide arrangements as confirmed to you. However, certain changes may be made to the accommodation and services resulting from circumstances in the location including but not limited to maintenance of the property, weather conditions or local religious holidays.
Where necessary, we reserve the right to change your accommodation to an alternative of the same or superior standard within Marrakech. If we are unable to confirm a suitable alternative, we reserve the right to cancel the booking and an email notification will be sent to inform you of the details. In these circumstances we will provide you with a full refund of all money paid to date.
Number of nights
Check in is from 3.00 pm and check out is 11.00 am. The number of nights stated in the booking confirmation refers to the number of nights the accommodation has been reserved for you. Some flights may be night flights; when you arrive in Marrakech your accommodation will only be available if you have reserved it for that night.
Indemnity
Only you and your party as notified to us can use the accommodation. You must not let anyone else stay there.
When you book accommodation, you accept responsibility for any damage to property and its contents or to the riad caused by you or a member of your party. We reserve the right to terminate your stay or that of any member of your party if, in the reasonable opinion of the manager, you or your party’s behaviour is such as to cause damage to the property, affect the safety or wellbeing of staff or others or disrupt or adversely affect the enjoyment of other guests. In these circumstances no refund will be given. Furthermore, we will be under no obligation to pay compensation or meet any costs or expenses you may incur as a result of your stay being terminated. You will be liable to make reimbursement to us for any losses, damages or expenses (including reasonable legal expenses) caused, due to the acts or omissions of you or your party. This includes but is not limited to cleaning, repairing or replacing property lost, damaged or destroyed and compensating any guest or staff affected.
Events beyond our control
These include but are not limited to war, threat of or preparation for war, riot, civil disobedience or strife, government action, terrorist activity, natural or industrial disaster, fire, flood drought, earthquake, adverse weather conditions, collapse of buildings, explosion or accident, imposition of sanctions, embargo, or breaking off of diplomatic relations, , epidemic, pandemic or serious risk to health, , nuclear, chemical or biological contamination or sonic boom, industrial dispute involving third parties, technical or maintenance problems , interruption or failure of utility service. or any failure in the information technology infrastructure or failure in internet connections. Except where otherwise expressly stated in these booking conditions we will not accept any liability or pay any compensation where the performance of our contractual obligations is prevented or affected by reason of such events beyond its control. In these circumstances you will receive a refund of any money paid.
Our liability to you
You must inform us without undue delay of any failure to perform or improper performance of the accommodation services. We will not be liable where any failure to perform or improper performance is due to you or another member of your party or a third party unconnected with us or is unforeseeable or unavoidable and beyond our control, the consequences of which could not have been avoided even if all reasonable measures had been taken.
Our liability, except in cases involving death, injury or illness, shall be limited to a maximum of three times the cost of your booking.
Complaints
If you have a complaint about your accommodation or any of the services provided you must inform us without undue delay and we will endeavour to put things right.
Health, safety and security abroad
Sadly, crimes against both people and their property are a fact of life the world over, and when in Marrakech it is very important to be vigilant and avoid drawing attention to yourself by wearing expensive jewellery, carrying expensive camera equipment etc. Travellers have the same responsibility for their personal safety and that of their possessions, as they do at home. We urge that you undertake reasonable precautions to protect your family and yourself whilst on holiday. Health and vaccinations
Health facilities, hygiene and disease vary worldwide. You should take health advice about your specific needs as early as possible and ensure that vaccinations or preventative measures are taken early enough to be fully effective by the date of travel.
